Tour Booking Process
Once your inquiry is received, a member of our Exclusive Yacht Vacations Reservations Team will respond to your Lead Contact (whom your Tour Group has designated to represent you all and will be the point person we will communicate with to plan your vacation) via email or phone within one business day to review and confirm the availability of your dates.
On confirmation that the dates you selected are available, we will email to the Lead Contact the Booking Contract Agreement and this Tour Terms & Conditions to review and sign on behalf of the group.
We hold your spot for 3 days, giving you enough time to finalise your travel details and pay the $5,000 deposit required to secure your booking.
Once we receive your signed documents, and the deposit, we consider your vacation booked. The balance owing plus IVA MX tax is due 30 days prior to the start of your vacation.
- The Contract
By signing the Vacation Booking Contract Agreement, you agree to the Terms & Conditions outlined herein. A contract exists as soon as Exclusive Yacht Vacations has received the duly signed agreements by your designated Lead Contact person. Notification of discrepancies should be made immediately.
The Lead Contact must be over the age of 18 years.
- Payment
A deposit of $5,000 of the vacation fee will be required at the confirmation. The balance plus 16% Tax is due 30 days prior to your departure date, the vacation price will not be subject to any changes once the deposit has been received by Exclusive Yacht Vacations.
Any monies paid for the tour booking (including any deposit) will be held by Exclusive Yacht Vacations in a separate account bonded against the risk of financial failure of Exclusive Yacht Vacations until the start date or earlier cancellation of the vacation where upon the monies will be released against the booking in accordance with this contract.
- Formalities
Once the following formalities have been completed.
- The Lead Contact has in their possession a signed confirmation by Exclusive Yacht Vacations, for their agreed dates.
- Submission of lead contact and guest and arrival details (no later than 2 weeks prior to tour)
- Obligations of Exclusive Yacht Vacations
Exclusive Yacht Vacations will provide our navigable yacht equipped pursuant to the laws and regulations in force of the flag and registration of the yacht at specified start time.
- Exclusive Yacht Vacations strictly prohibits the use or consumption of any illegal drugs on board.
It is understood that: UNDER NO CIRCUMSTANCE SHALL ANY MEMBER OF YOUR GROUP BRING ABOARD, USE OR CONSUME ANY ILLEGAL DRUGS ANYWHERE ON “LADY KANTA”. Exclusive Yacht Vacations has a zero-tolerance policy and the tour will be immediately cancelled. Exclusive Yacht Vacations shall not be held liable for any claims arising from or related to consumption of drugs.
- Smoking on YACHT VACATIONS.
Smoking tobacco will be permitted only on the top deck of YACHT VACATIONS. Smoking anywhere else is strictly prohibited – no exceptions.
- Obligations of the Lead Contact
By acceptance the Lead Contact certifies he completely understands and accepts Exclusive Yacht Vacations terms and obligations.
- Use of the vessel
The Lead Contact agrees to take on board the number of Passengers stated on the summitted guest list. (Any casual guests must not exceed the maximum number that the yacht is licensed for). The yacht is only to be used for pleasure. The vessel shall not transport merchandise, engage in trade, nor in any way violate the laws of any other government within the operating jurisdiction. The Lead Contact agrees and understands the restricted use of the Yacht to the ‘tours cruising area’. It is the responsibility of the Lead Contact and their guests to observe the laws of tour country. Animals are not allowed on YACHT VACATIONS without specific permission by Exclusive Yacht Vacations.
- Insurance
Exclusive Yacht Vacations is covered by a standard marine Yacht policy against direct physical loss to the vessel, bodily injury, property damage and civil liability. The Lead Contact and guests remain responsible for loss or damage from negligent or willful misuse of the Yacht or failing to adhere to the Exclusive Yacht Vacations briefing or onboard instructions. A supplementary insurance for cancellation is recommended. In addition, the Lead Contact is encouraged to review their current health and liability insurance to ensure proper coverage during the period of their charter.
- Complaint Procedures
The Lead Contact must notify the Exclusive Yacht Vacations base representative or Captain about any visible damage to the yacht prior to embarkation. Exclusive Yacht Vacations will work to resolve any concerns at that time. If the situation cannot be resolved prior to departure and you the client wishes to continue with the tour. You can summit in writing any issues within 14 days following the end of the tour. Exclusive Yacht Vacations will reply within 28 days. Under no circumstances will the level of compensation exceed the tour fee paid to Exclusive Yacht Vacations, any dispute arising from this complaint that cannot be resolved to the satisfaction of both parties will then be referred to arbitration.
- Changes to holiday
In the unforeseen event that EXCLUSIVE YACHT VACATIONS should not be available for your tour on the exact date agreed, I.E.., due to damage by the previous tour, Exclusive Yacht Vacations will provide reasonable accommodation ashore including meals until the yacht is either repaired or becomes available. In the event that Exclusive Yacht Vacations has to cancel the booked tour within the 10 days of the final payment period, a full refund will be given.
There will be no compensation paid in case of Force Majeure.
- Cancellation/Modification Fees
Cancellations must be made in writing, by the Lead Contact, and received by Exclusive Yacht Vacations prior to the start date. The date received by Exclusive Yacht Vacations office will be the date used to determine cancellation charges which are levied on the following scale:
If the tour is cancelled more than 12 weeks prior to the departure date: 100% of the tour deposit monies will be returned. Between 8 to 5 weeks: 50% of deposit tour fee will be returned.
Between 5 to 3 Weeks: 25% of deposit tour fee will be returned.
Less than 3 weeks: 100% of deposit tour fee will be forfeited.
Should the Lead Contact or tour group need to make a change to the booking after confirmation has been sent, I.E., tour dates, guest changes, after the 30-day final payment period, Exclusive Yacht Vacations reserves the right to make an administration charge of $500. If you request any major alterations during the 30-day final payment period, it will be treated as a cancellation and re-booking. Any alterations should be made in writing.
- Exclusive Yacht Vacations “ALL INCLUSIVE” definition;
The yacht will be professionally crewed, that all of the listed shore excursions along with Golfing, Deep Sea Fishing and water toys are in full working order and available. All meals will be professionally chef prepared to your requests, and all the standard bar which basically means bottled water, soft drinks, local beer, select wines, and spirits are included. Should you have any very specific request over our supplied provision list Exclusive Yacht Vacation will do their very best to accommodate all request. along with anything else not specifically included in the vacation fee.
Crew gratuity is also customary but discretionary at 10-20% of the fee.
- Governing Law and Venue
This agreement will be governed by USA Law and any disputes will be dealt with by the Mexican courts.
